CheckGeo.com ('we,' 'our,' or 'us') respects the intellectual property rights of others and expects users of our services to do the same. In compliance with the Digital Millennium Copyright Act (DMCA), we have adopted the following policy for handling claims of copyright infringement.

1. Policy Overview

It is our policy to:

  • Respond to clear notices of alleged copyright infringement that comply with the DMCA;
  • Remove or disable access to allegedly infringing material;
  • Notify the content provider, user, or member that we have removed or disabled access to material;
  • Terminate, in appropriate circumstances, account holders who are repeat infringers.

2. Infringement Notification

If you believe that material located on or linked to by CheckGeo.com infringes your copyright, you must send a written notification to our designated DMCA Agent that includes all of the following information:

  1. A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest;
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material;
  4. Information reasonably sufficient to permit us to contact the complaining party, such as a full name, mailing address, telephone number, and, if available, an email address;
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter Notification

If you believe that your content was mistakenly removed or disabled, you may file a counter notification. Your written counter notice must include the following:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number;
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the U.S., to any judicial district in which CheckGeo.com may be found), and that you will accept service of process from the person who provided the original notification or their agent.

4. Repeat Infringer Policy

CheckGeo.com will, in appropriate circumstances, disable and/or terminate the accounts of users who are repeat infringers. If you believe that a user is a repeat infringer, please follow the procedures outlined above to notify us and include sufficient information to identify the repeat infringer.

5. Policy Modifications

We reserve the right to modify or terminate this policy at any time without prior notice. It is your responsibility to review this policy periodically for changes.
